A Grand Jury decided to not to file any charges in a fatal truck accident that happened January 5th. A semi-truck driver was pulling out of the NTB Inc. trucking terminal when a 45-year-old woman driving a Buick Regal hit the side of the truck. The fuel tank burst into flames and the driver of the Buick was killed. She had a blood alcohol content of 0.23, far surpassing the legal limit in Ohio.

Prosecutor Gary Nasal said the grand jury was given options ranging from felony aggravated vehicular homicide to misdemeanor vehicle homicide.

No reason was given for the decision not to indict.

The disclosure of grand jury findings, usually kept secret unless there is an indictment returned, was approved Wednesday by Common Pleas Judge Robert Lindeman.

The accident happened near Tipp City on South County Road 25A. The 46-year-old man driving the semi-truck was able to get out of his truck on his own after the accident and when the flames started.
