One of the key aspects in valuating a trucking accident versus a standard automobile accident in Oklahoma is the fact that teh insurer of the trucking company can be named in the lawsuit. This is important on several fronts, if your unaware Oklahoma does not have a direct action statute that allows one in a normal car accident to directly sue the insurance company. Instead you sue the named driver and Courts do not allow even the utterance of the word insurance during trial. However, in a trucking accident, jurors are aware that the insurance company is the named party and thus by rendering a just verdict, they will not be driving the driver into bankruptcy. So keep in mind when you are injured by a semi-truck driver that you need quality and aggressive representation to get the true value of your claim.
